Specialist Payment Policies
1. Introduction
1.1. By registering and providing services as a Specialist through Still Mom (“Still Mom”, “the Company”, “we”, “our” or “us”), you (“Specialist”) agree to comply with these Specialist Payment Policies.
1.2. These Policies apply to services booked and paid for through the Still Mom Platform and should be read together with the applicable Specialist Agreement and the Still Mom Terms and Conditions.
1.3. Where there is any inconsistency between these Policies and an individually executed Specialist Agreement, the Specialist Agreement will prevail, subject to applicable law.
2. Payment Conditions for Meetings
2.1. Still Mom operates a platform connecting Clients with independent Specialists and facilitates the collection and transfer of payments relating to services booked through the Platform.
2.2. For a Meeting to qualify for payment to the Specialist:
- the Meeting details, including service, date, time, rate and location or delivery method, must be accurately recorded on the Platform;
- the Client must complete the applicable booking and payment process;
- the Specialist must provide the agreed service in accordance with the booking and applicable Specialist Agreement;
- the Specialist must confirm the Meeting in the Still Mom system within three (3) days after it takes place, where confirmation is required;
- the Specialist must not request or collect payment directly from Clients for services booked through Still Mom unless expressly authorized by Still Mom; and
- any cancellation or no-show charges must comply with the applicable cancellation policy published on the Platform and mandatory law.
2.3. Meetings should not normally be submitted or amended more than 31 days after the Meeting date, unless Still Mom expressly approves otherwise.
2.4. Where the applicable conditions are not satisfied, Still Mom may delay or withhold payment pending reasonable verification of the Meeting, the Client payment and the corresponding payment obligation.
3. Payment Processing and Monthly Payouts
3.1. Still Mom uses Stripe and other supported payment infrastructure to process Client payments and Specialist payouts.
3.2. Unless otherwise agreed in the applicable Specialist Agreement, remuneration for services properly provided by the Specialist during a calendar month will be paid once per calendar month.
3.3. Payment will normally be initiated on the 1st day of the following calendar month to the Specialist’s designated payout account through Stripe or another agreed payment method.
3.4. For example, remuneration relating to eligible services properly provided during September will normally be included in the payout initiated on 1 October.
3.5. The actual date on which funds become available in the Specialist’s account may depend on Stripe or other payment-provider processing times, the receiving bank, weekends, public holidays, payment verification or compliance checks, and other circumstances reasonably outside Still Mom’s control.
3.6. Specialists are responsible for ensuring that all payment-out, banking, tax and identification information provided to Still Mom or the payment provider is accurate and up to date.
4. Refunds, Adjustments and Payment Corrections
4.1. Where a Client is entitled to a refund under the applicable cancellation, rescheduling, statutory withdrawal, complaint or consumer-protection rules, the corresponding Specialist remuneration may be adjusted where appropriate and in accordance with the Specialist Agreement.
4.2. If a refund, chargeback, payment reversal, duplicate payment, technical error or other payment correction arises after remuneration has already been transferred to a Specialist, Still Mom may, where permitted by the Specialist Agreement and applicable law:
- adjust a future Specialist payout;
- request reimbursement of the relevant amount; or
- take another reasonable corrective measure.
4.3. Still Mom will provide reasonable information concerning any material adjustment to Specialist remuneration.
5. Commission Structure and Public Pricing
5.1. Still Mom may charge a commission or Platform fee in accordance with the applicable Specialist Agreement or commercial terms agreed with the Specialist.
5.2. The amount displayed to Clients may include the Specialist’s agreed remuneration together with an applicable Still Mom commission or Platform fee.
5.3. By way of example only, where a Specialist’s agreed rate is €50 and a 20% Platform charge is applied on top of that rate, the public Client price may be €60, subject to the applicable commercial arrangement.
5.4. The Platform does not normally charge Specialists a separate registration fee. Still Mom’s remuneration is generally linked to services successfully booked and paid for through the Platform, unless otherwise agreed.
5.5. The exact commission structure applicable to each Specialist is governed by the relevant Specialist Agreement or agreed commercial terms.
6. Changes to Specialist Rates
6.1. Specialists may request changes to their standard service rates in accordance with Still Mom’s applicable procedures.
6.2. Any revised rate will apply prospectively and will not automatically modify the price of Meetings that have already been confirmed or paid for.
6.3. Where different terms apply to existing Clients or existing service packages, the Specialist should submit the appropriate rate-change request to Still Mom before implementing the change.
6.4. Still Mom may need to update the public price displayed on the Platform to reflect the revised Specialist rate and applicable Platform charges.
7. Cancellations and Rescheduling
7.1. Client Cancellations
Where a Client cancels at least 24 hours before the scheduled start time, the Client is entitled to a full refund under Still Mom’s contractual cancellation policy, subject to any mandatory consumer rights.
Cancellations made less than 24 hours before the scheduled Meeting may be treated as late cancellations and may not qualify for a refund or credit, unless otherwise agreed or required by law.
7.2. No-Shows
Where a Client does not attend a Meeting and has not cancelled or rescheduled within the applicable timeframe, the Meeting may be treated as a no-show and no refund will normally be provided, subject to applicable law.
7.3. Client-Initiated Rescheduling
Clients may request to reschedule a Meeting at least 24 hours before the scheduled start time, subject to the Specialist’s availability. A request made less than 24 hours before the Meeting may be treated as a late cancellation unless otherwise agreed.
7.4. Specialist-Initiated Rescheduling
If a Specialist needs to reschedule a Meeting, the Client should be offered a reasonable alternative date or time. If no suitable alternative can be agreed, the Client will be entitled to a full refund for the affected Meeting.
7.5. Specialist Cancellation
Where a Specialist cancels a Meeting and no alternative is agreed, the Client will receive a full refund.
Cancellations and rescheduling should be recorded through the Platform’s designated booking-management functionality wherever available.
8. Complaints and Payment Disputes
8.1. Specialists should notify Still Mom promptly of any dispute relating to a booking, Client payment, refund or Specialist remuneration.
8.2. Clients are encouraged to report complaints relating to a Meeting as soon as reasonably possible and preferably within 24 hours after the Meeting. This preferred reporting period does not remove mandatory Client rights.
8.3. Still Mom may review relevant booking records, Platform communications, payment information and other appropriate evidence when assisting with a dispute.
8.4. Still Mom may facilitate reasonable solutions, including correcting a payment, issuing or facilitating a refund, adjusting a Specialist payout, providing credit, or taking another appropriate measure consistent with the applicable agreements and law.
8.5. Any proposed resolution by Still Mom does not prevent either party from pursuing rights or remedies available under applicable law.
9. Independent Specialist Status and Responsibility
9.1. Specialists provide services as independent professionals and are not employees of Still Mom.
9.2. Each Specialist remains responsible for:
- the quality and professional delivery of their services;
- maintaining any qualifications, licenses, registrations or insurance required for their profession;
- compliance with applicable professional and ethical obligations;
- applicable tax, social-security and reporting obligations relating to remuneration received;
- ensuring that the services described on the Platform are accurate; and
- complying with the Specialist Agreement, Still Mom policies and applicable law.
9.3. Still Mom facilitates bookings and payment processing but does not assume responsibility for the Specialist’s professional services except where required by applicable law.
10. Liability
10.1. Nothing in these Policies excludes or limits liability where such exclusion or limitation would be prohibited by applicable law.
10.2. Any contractual limitations of liability applicable between Still Mom and a Specialist are governed primarily by the applicable Specialist Agreement.
10.3. These Policies should not be interpreted as creating liability limits that are inconsistent with an individually executed Specialist Agreement.
